The Philippine Supreme Court declared as valid a section of a law providing a minimum base pay of not lower than salary grade 15 for nurses working in public health institutions.
But the SC did not grant the prayer of the petitioners to compel the implementation of Section 32 of the Philippine Nursing Act of 2002 because a law would be required to provide funds for it.
The SC ruled that an executive order that increased the pay for the Nurse I position to salary grade 11 from salary grade 10 is not a law.
The executive order was issued by then President Arroyo in 2009 to implement a joint congressional resolution, which, according to the SC’s ruling, cannot amend or repeal a prior law such as the Philippine Nursing Act because it is a mere resolution.
The SC’s decision was penned by Senior Justice Antonio Carpio.
